Introduction
Welcome to Spark CRM, a customer relationship management and business automation platform operated by Beyond Spark. These Terms of Service ("Terms") govern your access to and use of the Spark CRM website, applications, software, APIs, integrations, and related services (collectively, the "Services"). By creating an account, accessing, or using Spark CRM, you agree to these Terms. If you do not agree with these Terms, you should not use the Services.
1. Definitions
For these Terms: "Spark CRM," "we," "us," or "our" means Beyond Spark and the Spark CRM service. "You" or "User" means an individual, business, organization, or other entity using the Services. "Customer Data" means information, content, leads, contacts, communications, files, recordings, and other data submitted, imported, generated, or managed by you through Spark CRM. "Third-Party Services" means external platforms and services integrated with Spark CRM.
2. Eligibility
You must have the legal capacity to enter into these Terms. If you use Spark CRM on behalf of a company or organization, you represent that you have the authority to bind that organization to these Terms. Certain features require you to create a Spark CRM account and you agree to maintain the security of your account, notify us promptly of unauthorized access, and accept responsibility for activity occurring through your account.
3. Spark CRM Services
Spark CRM may provide features including: Lead collection and management, lead distribution, Meta Lead Ads and WhatsApp Business integrations, calling and call-related functionality, workflow automation, and reporting. We reserve the right to introduce, modify, suspend, or discontinue features where reasonably necessary to operate or improve the Services. Features may vary depending on your specific subscription plan and account configuration.
4. Customer Data Rights
You retain ownership of the Customer Data that you submit to Spark CRM. You grant Spark CRM a limited, non-exclusive right to process, store, and use Customer Data solely as necessary to provide and maintain the Services. You are responsible for ensuring that your use of Customer Data, lead collection, and management complies with applicable laws, including obtaining consent and providing legally required privacy notices.
5. Messaging & Calling
Users must comply with all rules and messaging restrictions of third-party platforms like WhatsApp. Where calling or call-recording is available, you are responsible for complying with all laws regarding consent, notification, and privacy. Spark CRM does not guarantee message delivery or recording availability across all devices and jurisdictions. You must not use the Services to send spam or unlawful content.
6. Third-Party Services
Spark CRM connects with third-party services like Meta and payment providers. Your use of those services is subject to their respective terms. We are not responsible for third-party outages, API changes, account suspensions, or data loss caused by these services. An integration may stop working if the third-party provider removes functionality. You agree not to use the Services for fraudulent activity or to violate another person's privacy.
7. Legal Rights
Spark CRM and its underlying software, interface, and designs are owned by Beyond Spark. You receive a limited, revocable right to use the Services during your active subscription. To the maximum extent permitted by law, Beyond Spark shall not be liable for indirect, incidental, or consequential damages. You agree to indemnify Beyond Spark from claims arising from your unlawful use of the Services or violation of these Terms.
8. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable in India. Any disputes shall be subject to the jurisdiction of the competent courts having jurisdiction over the parties. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to remain effective to the extent permitted by law.
